The contract will be governed by the laws of England and Wales and you agree to submit to the jurisdiction of the English courts. These terms and conditions do not affect your statutory rights as a consumer.

Placing an order online
When you place an order with us, you are making an offer to buy goods and you are agreeing to our terms and conditions.
It is really very simple to place an order with us, follow the steps below;
1. Browse through our website using our navigational bar, brand boxes, search box or highlighted products.
2. Once you have found the product you wish to purchase select ‘Buy Now’. For items that require a size you will be taken to the ‘select a size’ section, then add the applicable size to your basket. For items where no size is applicable simply add to basket.
3. You will then be taken through to your shopping basket. From here you can either ‘continue shopping’ or ‘proceed to checkout’.
4. You can checkout using your PayPal account or through Sage Pay, our secure payment system.
5. Checkout using PayPal – login to your PayPal account and check out as you normally would.
Checkout using Sage Pay – you can checkout as an account holder (where your details can be saved for future purchases by setting up a password) or you can checkout as a guest (quicker option).
· On either option you enter your email address and then first and last name – select ‘continue’.
· Set up your billing address and then if necessary set up a different delivery address – select ‘continue’.
· Your order will then be summarised to you along with your billing/ delivery address and any special instructions can be added. Select your preferred shipping method. See Delivery for full details on shipping costs. Please note that on this page Payment Method always selects Credit Card (this is the system set up). Once you select ‘continue’ you can pay by credit/debit card on the next page.
· Enter your payment details. Review your order and select ‘complete order’.
6. A confirmation email will be sent to you confirming that the order has been placed.
7. Cunningham’s will check stock availability on receiving your order. Whilst we do our best to ensure that products online are available on occasions there can be glitches on the system. In the event that the product you wish is not available we will notify you by email. Where possible we will always try to order it in for you, offer you an alternative or as a last resort cancel your order and no monies will be debited from your account. We will always wait to hear how you wish to proceed. (when you place an order with us online your card is authorised by the bank and money is ‘shadowed’ on your account however your account is never actually debited until the goods are dispatched)
8. Once goods have been processed and dispatched we will send you a confirmation email and the money will be debited from your account.
We strive to keep the information on our website as accurate as possible, however we are human and therefore fallible. We will not accept orders which contain pricing inaccuracies or where we feel an item has been described inaccurately.
Prices
All prices on our website include VAT.
Where customers are shopping online from VAT exempt countries, the VAT will be deducted at checkout.
Whilst we try and ensure that all prices are accurate we reserve the right to cancel an order if the item is mispriced. In all cases we would always contact you and give you the option of cancelling your order or paying the correct price.
All sale items or special offers are subject to availability and at the discretion of S R Cunningham’s. These can be withdrawn at any time.
On occasions we may offer products online at a discounted rate compared to our store prices. We are under no obligation to offer the same price for products online and in store. We are under no obligation to price match products online and in store.
Secure Online Shopping
We process all orders online using secure payment industry leaders Citrus Pay and PayPal. When you place an order your details will be secure as we use the (SSL) encryption method. This means your details are encrypted when they leave your computer and are only decrypted after they reach our computer. For ‘peace of mind’ look for the padlock symbol in the web address at the top of the page or ensure that the web page starts https://.
Payment is never taken until goods are dispatched. When you complete your order your bank authorises and shadows the money in your account. Citrus Pay collects money at the time of dispatch.
You can pay using a credit or debit card. We accept Mastercard, Visa, Maestro and American Express. Your billing address for online orders must be the same as the registered address for the card.
As an additional fraud measure we also use Verified by Visa and Mastercard Secure Code. This will ask for digits in a password that you have previously set up.
We do not have access or store any card details on our systems. All card details are securely encrypted by our secure payment services.
We will always prosecute users of fraudulent cards.

Complaints
Complaints will be dealt with fairly, confidentially and speedily. We will acknowledge the complaint within 5 working days and provide a time scale for resolving the dispute. We will keep you informed of what action we are taking.
